States attempting to ban
online casinos are running in to significant legal troubles. Not every
state is resorting to the same drastic measures as Kentucky. Kentucky
is in the middle of a legal battle to seize the domain name 141 online
casinos and internet gambling site because under Kentucky law the state
can seize illegal gambling device. A brilliant plan on the part of the
Kentucky Governor Steve Beshear, except he has been hard pressed to
reduce multibillion dollar, international companies like online casinos
to nothing more than a gambling device.
Minnesota is running into
a similar problem with their scheme against online casinos. Recently
the Alcohol and Gambling Enforcement division of the Minnesota public
safety department requested that 11 Internet service providers block
over 200 online casinos and gambling sites.
“Our only goal is to deal with online gambling,”
said John Willems, director of the public safety department.
“We're not trying to shut down the sites, we're not
trying to seize assets.”
Once again, Minnesota law enforcement has hinged
their plan on a particular clause in their law books. According to
Minnesota state law, law enforcement officials are given the authority
to demand common carriers cease the transmission of gambling
information.
This would include online casinos if cable and
telecommunication companies were considered common carriers. Back in
2005, the United States Supreme Court ruled that cable companies
offering broadband services are to be considered information service
providers, not common carriers. Later that same title was extended to
companies offering DSL.
