The nation may not have to wait for a Congress to
regulate online casinos. While Barney Frank is doing his best to repeal
the Unlawful Internet Gambling Enforcement Act, states may take the
matter into their own hands. The precedent in the United States is that
gambling is a state issue, not to be federally regulated. With that in
mind California is already actively pursuing the legalization and
regulation of online poker within the state. New Jersey may take it one
step further. A gaming expert has put forth the idea of licensing
online casinos within the state.
In recent years, state after state has introduced
slot machines opening up the corner of the gambling market in the
northeast that used to be dominated by New Jersey. As an idea to
maintain the competitiveness of New Jersey, Frank Catania has proposed
regulating online casinos with in the state. Catania has quite an
impressive resume as the former assistant attorney general and one time
head of Gaming Enforcement in New Jersey. His opinion holds a lot of
sway.
The Unlawful Internet Gambling Enforcement Act exempts instate online
casinos and Internet gambling. Although the Department of Justice may
not be happy with any state that decides to regulate online casinos, it
is fully within the power of the states to do so.
Further more, although the Department of Justice
likes to present the Unlawful Internet Gambling Enforcement Act as the
law that banned online casinos in the United States, there is no actual
law against online casinos.
